Privacy Disclosure, AML/CFT Act and Responsible Lending Declaration

1. Collection of Personal Information

You authorise Beta Finance Limited, its employees, agents, advisers, and service providers to collect, hold, use, and disclose personal information about you for the purposes described in this document.

Your personal information will be collected and handled in accordance with the Privacy Act 2020, the Credit Contracts and Consumer Finance Act 2003, and the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.

Information collected may include (but is not limited to):

  • full legal name and date of birth

  • residential address and address history

  • contact details

  • identification documentation

  • employment details and income

  • financial position including assets and liabilities

  • banking and credit history

  • repayment history and credit obligations

  • information relating to loan security

  • any other information reasonably required to assess your credit application or manage a credit facility.

Information may be collected directly from you or from third parties.

 2. Authority to Obtain and Exchange Information

You authorise Beta Finance Limited to obtain and exchange information about you with third parties for the purpose of assessing your application and administering any credit facility.

These parties may include:

  • credit reporting agencies

  • banks and financial institutions

  • current or previous lenders

  • employers or accountants

  • mortgage advisers or financial advisers

  • insurers and valuers

  • identity verification providers

  • government agencies or regulators where required by law.

You authorise these organisations to provide information about you to one of the companies in Beta Finance Limited which provides the credit facility. The specific lender will be identified in the Loan Agreement and Disclosure Statement.

We will disclose personal information which may be required to uphold or enforce the law or otherwise in accordance with the AML/CFT Act or the Privacy Act.

 3. Credit Reporting Authorisation

You authorise Beta Finance Limited to obtain a credit report about you from credit reporting agencies for the purposes of:

  • assessing your creditworthiness

  • verifying your identity

  • managing any credit facility.

You acknowledge that information relating to your credit obligations may be disclosed to credit reporting agencies and other credit providers, including information relating to:

  • credit enquiries

  • repayment history

  • defaults or overdue payments.

  • address search

You understand that you can access your personal credit information from Equifax and that if it is incorrect, request that it be corrected. The information can be accessed through Equifax email for Public Consumer Enquiries on contact number they have provided on their website 0800 692 733 or email publicaccess.nz@equifax.com

You also authorise access to your personal information from the following agencies: Personal Properties Securities Register, Transport Registry Centre (NZ Transport Agency) Drivers Licence Database, NZ Transport Agency Motor Vehicle Ownership Register, Ministry of Justice (MOJ), Other Government Agencies, Repossession Professionals authorised by us.

4. Identity Verification and AML/CFT Compliance

To comply with obligations under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, you authorise Beta Finance Limited to:

  • verify your identity using identification documents

  • conduct electronic identity verification

  • obtain information from independent sources to confirm your identity

  • obtain information regarding the source of funds or wealth where required.

·        obtain and use third party biometric identification platform NameScan or RealAML. We will use your personal information such as names, date of birth, nationalities, and sex to determine if there are any matches on global sanctions register, or connections to being a politically exposed person.

You acknowledge that services may be declined if identity verification requirements cannot be satisfied.

 5. Responsible Lending and Financial Information Declaration

To comply with responsible lending obligations under the Credit Contracts and Consumer Finance Act 2003, the lender must assess whether the loan is suitable and affordable.

By signing this document, you confirm that:

  • the financial information you have provided is true, complete, and accurate

  • you have disclosed all income, expenses, debts, and financial commitments

  • the lender is entitled to rely on the information provided by you when assessing your loan application

  • you understand the financial obligations associated with the loan

  • you will notify the lender if any information provided changes prior to the loan being advanced.

 6. Use and Disclosure of Personal Information

Your personal information may be used or disclosed for the purposes of:

  • assessing your loan application

  • arranging, providing, and administering credit

  • complying with legal and regulatory obligations

  • fraud prevention and risk management

  • enforcing contractual rights

  • communicating with you regarding your loan.

Information may be disclosed to service providers who assist with administration, compliance, technology, or professional services.

 7. Storage and Security of Information

Personal information will be stored securely and protected against loss, misuse, or unauthorised access.

Information may be stored electronically, including in secure cloud systems, or in physical records.

8. Retention and Destruction of Personal Information

Personal information will only be retained for as long as necessary for the purposes for which it was collected and to comply with legal obligations.

Certain records, including identity verification information, must be retained for a minimum period in accordance with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 and other applicable laws.

Unless required to be retained for longer, personal information will generally be retained for at least five (5) years after the end of the lending relationship.

After this period, personal information will be securely destroyed, deleted, or anonymised.

You have the right to request access to, and correction of personal information held about you.

GPS privacy waiver

Purpose of GPS Installation:

This waiver acknowledges that a Global Positioning System (GPS) tracking device will be installed in the above-referenced vehicle. The purpose of this GPS installation is to:

  • Assist with vehicle recovery in the event of default on the loan.

  • Monitor the vehicle’s location as permitted under the terms of the loan agreement.

  • Deter fraud and improve asset protection.

Customer Acknowledgment & Consent:

By signing this document, I, the undersigned customer, hereby acknowledge and agree to the following:

  1. A GPS device will be installed in the vehicle as a condition of financing.

  2. The GPS may transmit real-time location data to the finance company or its authorized representatives.

  3. I understand that the GPS device is used solely for business and asset protection purposes, and not for personal surveillance.

  4. I am aware that this device may be used to locate the vehicle if I fail to comply with the terms of my loan.

  5. I understand that the presence of the GPS device may not be physically noticeable or removable without impairing loan conditions.

  6. I acknowledge that I have been informed of any fees associated with the GPS installation, and these fees have been disclosed to me in the loan agreement.

Privacy & Data Use:

The information obtained through the GPS device will be used only by the lender or authorised parties in accordance with applicable privacy laws. Data collected will not be sold or disclosed to third parties except:

  • As required by law;

  • In the event of a loan default;

  • To recover the vehicle or protect the company’s interest.
